CONSUMER PROMOTION TERMS & CONDITIONS
CONDITIONS OF ENTRY
1. Information on how to enter and details of the Prizes form part of these Conditions of Entry (Conditions). Entry into the Tasmanian Heritage Winter Blues Consumer Promotion (Promotion) is deemed to be an acceptance of these Conditions.
2. Promotion commences at 12.01 am (AEST) on 28 June 2010 and entries close at 11.59 pm (AEST) on 13 August 2010.
3. Entry is only open to Australian residents over 18 years old. Employees (and their immediate families) of the Promoter, or agencies or companies associated with this Promotion, are ineligible to enter.
HOW TO ENTER
4. To enter the Promotion, you must, during the Promotion Period:
(a) Purchase two wedges of Tasmanian Heritage cheese (minimum 250gm total purchase) at independent gourmet deli stores advertising the Promotion (Participating Outlets) in NSW, SA, Qld, Vic or WA (Participating States). (Eligible Purchase)
(b) You can then collect an entry flier from your Participating Outlet and enter either by SMS Entry or Online Entry by:
(c) (SMS Entry) send an SMS message to 1991 1515 containing the following information in the following order:
(A) FIRST: the code on your entry flier;
(B) SECOND: your first name and surname;
(C) THIRD: Participating Outlet where purchase was made
All entrants must retain their receipt or proof of purchase in order to claim their Prize if deemed a winner.
EXAMPLE ENTRY:

or
(d) (Online Entry) log on to the website www.tasmanianheritage.com.au, click on the Winter Blues tab/link to take you through to the promotional pages and fully complete the online entry form by providing your promotion code, first name, surname, post code, telephone number.
5. Individuals can submit multiple entries. There is a limit of one entry per Eligible Purchase. Errors and omissions in entries may be accepted at the Promoter’s absolute discretion.
6. Each valid SMS entry into the Promotion must be contained in a single SMS from a mobile telephone connected to an Australian based mobile network with premium SMS (being any one of the Telstra, Vodafone, Virgin or Optus mobile digital networks or a participating service provider which has SMS compatible mobile digital phones). The telephone number of the mobile telephone from which the SMS is sent must not be withheld. Maximum call cost of SMS message will not exceed 55 cents including GST. 7. Any entry that is lodged by automatic, repetitive, robotic, programmed or similar entry methods or agents, including the use of a competition entry service, will void all entries by that entrant.
8. The mobile phone number from which the entrant sends the SMS entry must be owned by the entrant. The Promoter may require a winner to validate their entry by showing proof of ownership of the mobile telephone number. The only acceptable proof of ownership will be an original invoice in the name of the entrant or an original letter on the service provider’s letterhead confirming the entrant’s ownership. If an entrant is unable to provide proof of ownership of the mobile telephone number within 14 days of request by the Promoter, the entry will be treated as void and the Prize will be treated as an unclaimed Prize. Entrants to the promotion will receive a reminder that the promotion is ending on August 13 , 2010 two weeks prior to that date.
Prizes
9. There are 5 Prizes in total to be won, 1 Prize will be awarded per Participating State. Entrants will only be eligible to win a Prize in the Participating State where they make their Eligible Purchase.
The first valid entry drawn from each Participating State will win the following food and wine packages for 2 persons:
NSW – Hunter Valley Peppers Convent Package including 2 nights accommodation in a Superior Room, buffet breakfast, 1 x 3 course dinner at Robert’s Restaurant, 1 x 3 course dinner at Chez Pok, Champagne on arrival, pre-dinner drinks and canapés with onsite wine tasting and information valued at $1440.00.
WA – Margaret River Cape Lodge Package including 2 nights accommodation in a Garden Wing room, daily gourmet breakfast, daily afternoon tea, one gourmet dinner platter for two and bottle of wine served in the privacy of your suite, one of the Chef’s 5 course tasting menu for two people in the award winning restaurant plus a Margaret river wine tour. Total value $2,175.00.
SA – Barossa Valley The Louise Package includes 2 nights accommodation in a Vineyard Suite, continental breakfast daily, welcome gift of seasonal fresh fruit and house baked cookies on arrival, decanter of local port wine, water, coffee and tea making supplies throughout the stay plus Barossa Experience wine tour. Total value $1829.00.
QLD – Gold Coast Hinterland Vineyards Package includes 2 nights accommodation in a garden villa, comprehensive breakfast menu, fruit in villa on arrival, 3 course dinner on one evening plus Taste of Tamborine Tour. Total value $1587.00.
VIC – Yarra Valley Balgownie Estate Package includes 2 nights spa suite accommodation, gourmet breakfast for 2 in Rae’s Restaurant, $100 voucher for Rae’s Restaurant, bottle of MG Sparkling Pinot Noir Chardonnay on arrival plus a Yarra Valley winery tour. Total value $1397.00.
Each winner will need to directly book and confirm their Prize with an authorised agent. National Foods will inform winners of the details of authorised agents when they contact winners to inform them that they have won a Prize. Packages are valid until the 23rd December, 2010. All other costs and expenses incurred in relation to the Prize are the responsibility of the winner. .It is the responsibility of winners to arrange their own transportation to and from destinations.
10. Total Prize pool is valued at $8428.00 (including GST)
11. The value of the Prize is accurate at the date of commencement of the Promotion Period. The Promoter accepts no responsibility for any variation in the value of the Prize after that date. The Prize cannot be transferred, exchanged or redeemed for cash. Where a Prize is unavailable, the Promoter retains the right to substitute the Prize with a Prize of equal or greater value, subject to the directions of any of the relevant State gaming authorities.
How winners are determined
12. All entries will be placed into a Prize Draw for the Participating State where the entrant made their Eligible Purchase. The Promoter will conduct 1 Prize Draw per Participating State (5 Prize Draws in total) to randomly determine one winner per Participating State for each of the 5 Prizes at SAM Sales & Marketing, 272 Bay Street, Port Melbourne, 3207 on the 18th August, 2010 at 12 noon.
Notification of winners
13. All winners will be contacted by telephone (for SMS Entries) or email (for Online Entries) by the 20th August, 2010. Each winner of a Prize must provide the Promoter with the winner’s address when contacted via telephone or email to enable the Promoter to notify the winner in writing.
14. The winners’ names will be published in the public notice section of The Australian newspaper on the 25th August, 2010.
Unclaimed Prize Draw
15. If required the Promoter may conduct an Unclaimed Prize Draw on the 25th November, 2010 at 12.00 noon at SAM Sales & Marketing, 272 Bay Street, Port Melbourne, 3207 as is necessary for any unclaimed Prize or to distribute any Prize awarded to a winner whose entry has been deemed invalid, subject to any directions given by any of the relevant State gaming authorities. All valid entries received during the Promotion Period (other than those relating to a winner who’s entry or entries are deemed invalid by National Foods in accordance with these Conditions, will be eligible to win any Unclaimed Prize. The first valid entry randomly drawn for each Unclaimed Prize will win that Prize.
16. All winners of an Unclaimed Prize will be notified by telephone (for SMS Entries) or email (for Online Entries) by 27th November 2010. Each winner of an Unclaimed Prize must provide the Promoter with the winner’s address when contacted via telephone or email to enable the Promoter to notify the winner in writing.
17. The winner/s of any Unclaimed Prize will be published in The Australian on 29th November, 2010
General Conditions
18. The Promoter’s decision is final, and no correspondence will be entered into.
19. All entries are deemed to be received by the Promoter at the time of receipt into the Promoter’s database and not at the time of transmission by the entrant. SMS Entries from a mobile telephone not connected to an Australian based network with premium SMS are not valid and will not be accepted.
20. The Promoter, in its absolute discretion, reserves the right to verify the validity of all entries and to disqualify any entrant who tampers with the entry process, including but not limited to, by using techniques designed to avoid payment of call costs, or who submits an entry that is not in accordance with these Conditions.
21. Unless otherwise due to fraud or ineligibility under these Conditions, all Prize claims in excess of the advertised total Prize pool will be honoured. Printing errors or other quality control matters outside of the control of individual entrants shall not be used as the sole basis for refusing to award the Prize.
22. The Promoter and its associated agencies or companies accept no responsibility for lost, late, stolen, damaged or misdirected entries.
23. If for any reason this Promotion is not capable of running as planned, the Promoter reserves the right in its absolute discretion to modify the terms of the Promotion including the Prizes and these Conditions, subject to approval of the relevant State gaming authorities.
24. Any tax liability arising as a result of accepting any Prize is the responsibility of the winner.
25. Except for any liability which cannot be excluded by law, the Promoter:
(1) is not responsible for any problems or technical malfunction of any telephone network or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on any computer system or at any website, or any combination thereof, including (but not limited to) any injury or damage to participants or any other person’s property related to or resulting from participation in this Promotion;
(2) accepts no responsibility for any incorrect or inaccurate information, either caused by users or by any of the equipment or programming associated with or utilised in connection with this Promotion, or by any technical error that may occur in the course of this Promotion, including (but not limited to) any failure of the computer system or other equipment to determine winners in accordance with these Conditions of Entry; and
(3) accepts no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries or entrants details.
26. The Promoter and its associated companies and agencies will not be liable for, and by receiving, taking or using any Prize each winning entrant is deemed to release the Promoter and its associated companies and agencies from, any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or any personal injury suffered or sustained as a result of receiving, taking or using any Prize except for any liability which cannot be excluded by law. The Promoter holds the benefit of this clause on its own behalf and as trustee for its associated companies and agencies.
27. All claims and entries become the property of the Promoter.
28. By entering this Promotion, each entrant consents to the Promoter using the entrant’s personal information to administer the Promotion and announce the winner and disclosing the entrant’s personal information to organisations that assist the Promoter with administering the Promotion and announcing the winner, and to third parties as required by law (including authorities that regulate this Promotion). By entering into this Promotion, each entrant also consents to their personal information being used by the Promoter for future marketing and promotional purposes (other than marketing or promoting via email). The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth). Entrants can access and correct the personal information the Promoter holds about them by contacting the Promoter on 1800 677 852. The Promoter’s full privacy policy is available on request.
